Terms of Service

Effective / last updated: September 18, 2026
These Terms of Service explain the basic rules that apply when you use the MemorialEver mobile app and the web pages we provide. Please read them before using the service.
The fact that a feature is described here does not mean that an unreleased feature is currently available. The features visible in the version offered to you are the ones that apply.

1. Operator, scope and acceptance

MemorialEver is the name used in these documents for the service operator and data controller. Because no separate company/legal entity name or postal address has been approved for this version, this document does not claim one. You can contact us at destek@hatirasina.com about privacy, support and personal-data requests.
By creating an account or using the service, you agree to these terms and the Privacy Policy. Any separate privacy notice or explicit-consent process required for personal data is handled independently from acceptance of this agreement.

2. Purpose of the service

MemorialEver is a service solely for creating Memorial Pages for loved ones who have passed away. The mobile app supports the owner/administrator experience; where available, the web supports marketing, legal/help pages, Memorial Page viewing and guest contributions. MemorialEver is not a social network.
The current app includes local draft creation, account verification, creation and management of a Memorial Page with an active subscription, publication with the selected visibility, sharing, and management of text-based guest contributions subject to mandatory moderation.

3. Account responsibilities

You must provide accurate and current account information, keep your email account and device secure, and never share one-time verification codes. If you suspect unauthorised use of your account, contact support.
If you sign in with Apple or Google, that provider’s own terms also apply to its service.

4. Creating a Memorial Page and third parties

You may create a Memorial Page only for a deceased person. The page owner is responsible for having all rights, authority and permissions needed to share information and content about the deceased, family members and other third parties.
This provision does not make a general claim about the legal rights of deceased people or their relatives. Before sharing sensitive, private or child-related information, you should consider the permissions required and the law that applies.

5. User content and your rights

To the extent you legally own the rights in your photos, videos, audio, life stories, memories and other content, those rights remain yours. MemorialEver does not claim ownership of your family photos or stories merely because you upload them.
By uploading content, you give MemorialEver only the limited, non-exclusive permission needed to provide the service: to host, store, technically process, resize or convert the content; display it according to the visibility you choose; and deliver it to devices. This permission does not allow independent advertising or unrelated commercial use of the content.

6. Permissions required for content

Content you upload must belong to you, or you must have the permissions needed to use and share it. The user who adds content is responsible for content that infringes another person’s copyright, personality, privacy or similar rights.

7. Guest contributions and moderation

An owner account is not required to submit a text-based guest contribution. Every contribution first remains private and pending, and is not published until the Memorial Page owner approves it. The owner may review, edit, approve or reject a contribution. Guest photo, video and audio contributions are not yet available.

8. Privacy and visibility options

When publishing is available, the Memorial Page owner may choose Public, Link Only or Password Protected visibility. Public pages may be indexed by search engines. A Link Only page can be opened by anyone who knows the link and is not equivalent to password protection. Access to a Password Protected page is verified on the server.
Choosing a visibility preference for a private draft does not publish the page. Subscription expiry does not automatically make a page Public or weaken password protection.

9. Prohibited uses

•
Uploading unlawful, harassing or abusive content
•
Infringing another person’s intellectual-property, privacy or personality rights
•
Acting without authority for a person or organisation, impersonating someone or committing fraud
•
Uploading malicious files or code, or attempting to bypass service security
•
Disclosing private or sensitive information without authority
•
Sending automated or excessive requests that disrupt the service, infrastructure or other users

10. Rights belonging to MemorialEver

Rights in the MemorialEver name, logo, app design, software and original service materials belong to their respective rights holders. These terms do not permit you to copy or commercially use service materials other than your own user content.

11. Service availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Features may be changed, restricted or removed for maintenance, security, technical necessity or product-scope reasons. We will provide an appropriate notice when a change materially affects user rights.

12. Subscription requirement

Valid monthly, annual, or lifetime creator access is required to create, save to the cloud, own, manage, or publish a Memorial Page. There is no free creator/administrator plan or separate “Premium feature” tier. A lifetime purchase removes access expiration; it does not provide unlimited Memorial Page capacity. Visitors do not need a subscription to view a published Memorial Page.

13. Monthly and annual auto-renewing subscriptions

Under the target product model, an eligible monthly subscription includes a seven-day store-managed free trial and begins monthly billing unless cancelled. An annual subscription has no free trial and is charged annually on purchase confirmation. Until the coordinated store transition is complete, the product, eligibility, trial and renewal terms displayed by the store checkout remain authoritative.
The current price, currency, taxes and exact store billing time are shown on the Apple App Store or Google Play screen before purchase confirmation. These terms do not fix a price.

14. Purchase, management and cancellation

The Apple App Store or Google Play processes the purchase. RevenueCat helps communicate entitlement and restore status to the app; it is not described as the party that processes your payment card.
You can manage or cancel a subscription through the account/subscription settings of the platform where you purchased it. The effective time of cancellation, renewal cut-off and billing rules are governed by the terms shown by that store. Timely cancellation of a monthly trial prevents the first monthly charge according to store terms. Annual trials started before the transition remain valid until the expiry or conversion date reported by the store.

15. Refunds and restoring purchases

Refund requests and eligibility are handled under the rules of the Apple App Store or Google Play that processed the purchase, together with mandatory consumer law. MemorialEver does not make a unilateral refund promise on behalf of the store.
Restore Purchases matches the entitlement again using store and RevenueCat records; it does not create a new purchase.

16. When a subscription ends

If an active entitlement ends, creation and management actions may be blocked until you subscribe again or restore a valid purchase. Existing published pages remain available to visitors according to their own privacy setting and are not automatically changed to a more open mode.
A long-term retention and possible cleanup policy for media belonging to expired subscriptions has not yet been approved. These terms do not promise a specific retention period or automatic deletion. Destructive deletion solely because a subscription ended is not intended before a policy is established.

17. Termination of an account or service access

Access to relevant content or an account may be proportionately restricted in the event of a serious or repeated breach, a security risk, a legal requirement or use that harms the service. Where applicable, the user will be given an explanation and a support or appeal channel.
The account-deletion flow under Profile > Account Information permanently deletes owned Memorial Pages, related content and the account after an explicit confirmation phrase and a second confirmation. This cannot be undone. You may need to manage the subscription separately through the store; store transaction records are subject to the store’s retention rules and applicable law.

18. Limitation of liability

To the extent permitted by applicable law, MemorialEver is not liable for consequences arising from a user’s unlawful or unauthorised content, a user’s failure to secure their device or account, or outages in store and communications infrastructure beyond our control. Nothing in these terms removes mandatory consumer rights or liabilities that cannot legally be limited.

19. Apple distribution terms

Distribution of the iOS app through the App Store may also be subject to Apple’s applicable distribution terms and Standard End User Licence Agreement. This page contains the MemorialEver service terms and is not intended to amend or replace Apple’s Standard EULA unless a legally approved custom EULA is explicitly selected in the store listing.

20. Mandatory applicable rules

Because no individual/legal-entity operator identity and related governing law or competent jurisdiction have been approved for this version, this document does not select a specific court or jurisdiction. Applicable mandatory law and consumer rights remain reserved. This section requires legal review before production.

21. Changes to these terms

The terms may be updated if the service or legal requirements change. The current date is shown at the top of the page. An appropriate notice method will be used for changes that materially affect your rights.
